Article 1: object
The purpose of these general conditions of sale is
to inform any potential consumer of the terms and conditions under which the seller (KALIE) sells and delivers the products ordered
to define the rights and obligations of the parties in the context of the sale of products by Kalie to the consumer (known as the Buyer). They apply, without restriction or reservation, to all sales, products offered on this website www.kalie.shop
Consequently, any person ordering a product offered for sale on the KALIE Website fully accepts these general conditions of sale, of which the Buyer acknowledges having read prior to his order.
The products are offered for sale and delivery in the following geographical territories: Madagascar, metropolitan France, all member countries of the European Union, Switzerland, the United States and Canada, Africa, Oceania, Asia.
The Purchaser, prior to his order, declares the purchase of products on this site is not directly related to a professional activity and is limited to strictly personal use; except agreement requested from the directors of the company.
Any order that clearly does not correspond to a retail sale and, more generally, any order that is fraudulent or presumed to be such, will be considered null and void.
Kalie reserves the right to modify these general conditions of sale at any time.
The General Conditions of Sale applicable to the order placed by a Buyer on the Site are those accepted at the time of placing such an order. These General Conditions of Sale supplement the conditions of use of the site.
Article 2 - Formation of the contract and orders
The sale prices of the products online on the e KALIE website, indicated excluding taxes and in euros, are those in force at the time of registration of the purchase order by the Buyer.
These prices can be modified at any time by Kalie. This change will be notified to the Buyer before any order. They do not include shipping costs (billed in addition to the price of the products purchased) depending on the amount and weight of the order. These shipping costs will be indicated before the registration of the order by the Buyer.
Before any order, the Buyer can read, on the Kalie website, the essential characteristics of the product(s) he wishes to order.
The Buyer can select one or more products from the different categories offered on this site.
Kalie is likely to modify any assortment of products offered for sale on its site without prejudice to orders placed by the Buyer.
Any order assumes acceptance of these general terms and conditions of sale, without prejudice to the specific contractual conditions concluded between the Parties.
The Buyer has the possibility to check the details of his draft order before validation of it and to correct any errors.
From the moment the Buyer confirms his order by clicking on the Validate icon, he is considered to have knowingly accepted these general conditions of sale, the prices, volumes and quantities of the products offered for sale and ordered by the Buyer.
The order validated by the Buyer will be confirmed by KALIE. The sale will be final upon full payment by the Buyer and/or by any appropriate means (the " Order Confirmation ") and an email will be sent to him when his order is dispatched.
Kalie reserves the right to suspend or cancel any execution of an order and/or delivery, whatever its nature and level of execution, in the event of an act deemed suspicious.
No more changes can be made once the order has been validated and acknowledged by Kalie. However, in the event of an error in the data entered by the Buyer, the latter is invited to inform Customer Service by email at contact@kalie.shop
Article 3 - Payment
Payment must be made when ordering online by the Buyer (with the exception of customers located in Madagascar). At no time can the sums paid be considered as a deposit or down payment.
All orders are payable in euros, all taxes and mandatory contributions included. To pay for his order, the Buyer has the following method of payment: bank card under the detailed conditions (Carte Bleue, Visa and MasterCard) paypal and on delivery for all persons located in Madagascar.
Payments made by credit card are made through the secure Shopify Payments system (online payment tool provided by Shopify). It uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and that no third party can read it during transport on the network. In case of payment by credit card, the buyer's account will be debited on the day of his order.
In order to ensure the security of payment by bank card, the Buyer must send Kalie the visual cryptogram (CVV) appearing on the back of the bank card used by the Buyer.
Payments made by mobile money (only valid in Madagascar) will be confirmed to the Buyer by a message or a call from Kalie. These must include in the transaction reason: "order number + first name".
Payments made on delivery (only valid in Madagascar) are made through our service providers. The package containing the order will not be delivered to the buyer or the recipient of the order without having validated the order.
The Buyer guarantees to KALIE that he has the necessary authorizations to use the method of payment he has chosen for his order, when registering his order form.
Kalie reserves the right to suspend or cancel any execution of an order and/or delivery, regardless of its nature and level of execution, in the event of non-payment or partial payment of any sum due by the Buyer, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the Website.
The delivery of any new order may be suspended in the event of late payment or partial payment of a previous order, notwithstanding the provisions hereof.
Article 4 - Delivery and reception
The products subject to a final order from the Buyer under the conditions described above will be delivered to the address indicated by the Buyer on the order form, in Madagascar, in mainland France, in the member countries of the European Union, Switzerland, the United States and Canada, Africa, Oceania, Asia.
By default, purchase invoices are sent by e-mail to the e-mail address indicated by the Buyer when registering on the KALIE website. Failure to comply with the contractual conditions described below, no claim by the Buyer will be accepted.
Depending on the size of the package and the place of delivery indicated by the Buyer, one or more delivery method(s) will be offered to the Buyer when placing the Order.
Whatever the delivery method, the Buyer or the recipient of the products ordered is invited to check the apparent condition of the products on delivery.
There is a mode of delivery in metropolitan France, in the member countries of the European Union, Switzerland, the United States and Canada, Africa, Oceania, Asia.
DHL : this is the only delivery method offered by KALIE in mainland France, in the member countries of the European Union, Switzerland, the United States and Canada, Africa, Oceania, Asia.
The package containing the products ordered and paid for is delivered to the address indicated by the Buyer against signature. The signature affixed by the Buyer or the recipient of the order is proof of delivery and receipt by the buyer or the recipient of the order of the products ordered. No dispute relating to the delivery itself is possible.
KALIE offers several delivery methods in Madagascar:
Antananarivo: the package containing the unpaid ordered products is delivered to the Buyer or the recipient of the order through our delivery service providers. The package will not be delivered without having made the payment due to the delivery person or confirmation of payment by mobile money from the manager.
In the provinces: the package containing the products ordered and paid for is deposited with the service chosen in advance by the Buyer (in an additional note when confirming the order). Kalie undertakes to subsequently send all information relating to and necessary for tracking the package to the Buyer or the recipient of the order. Kalie declines all responsibility in the event of loss or theft of the package containing the products ordered after deposit with the service chosen by the Buyer.
In the case of the loss of parcels, KALIE is responsible for initiating recourse against the carrier to proceed with the declaration of loss, requesting an investigation into the parcel. is obliged to respect the deadlines imposed by the carriers concerning the declaration of loss, the investigation and the reimbursement/return of the order. In fact, the Buyer is also bound by these deadlines.
The Buyer or the recipient of the Order must report the absence or damage to the product to Kalie's Customer Service in order to request a refund or a new shipment of the products ordered. Kalie will bear all the costs of return / reshipment concerning an anomaly born prior to taking possession of the product and therefore the transfer of risks to the consumer. A compensation, refund or exchange of the product will be offered to the Buyer, depending on the anomaly noted.
In any case, the Buyer is informed that the products ordered will be delivered within a maximum period of thirty days from the day following that on which the Buyer registered his order, subject to full payment of the price.
For countries (other than Madagascar) customs taxes may possibly be payable. It is up to the Buyer to contact the customs services of his country to make a customs declaration if necessary. The company Kalie can in no way be held responsible for any additional costs related to these customs taxes.
Article 5 - Right of withdrawal and return of products
You have the right to withdraw from this contract without giving any reason within seven days. The withdrawal period expires seven days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods. In the event of an order sent in several packages, the withdrawal period for the order begins to run the day following receipt of the last product of the order.
To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous declaration in the form of your choice to the email address contact@kalie.shop. This right cannot be exercised when the subject of the contract relates to the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned.
The right of withdrawal creates an obligation to return the products of the order. The Buyer has a period of 7 (seven) clear days from the day of receipt of his order by himself or by the recipient of the order, to return his entire order at his own expense and obtain, at the Buyer's choice, the exchange of products, or a credit note or a refund corresponding to the amount of his order.
We will make the refund using the same means of payment as you used for the initial transaction, unless you expressly agree to a different means; in any case, this refund will not incur any costs for you.

The return costs following the withdrawal or for errors made by the Buyer when placing his order, voluntary exchange will be borne by the Buyer.
